NANNY AND HOUSEKEEPER SERVICE

 

Definitions

“Applicant, Nanny and Home-helper” refers to a person introduced by the agency to the Client for employment in respect of childcare or home help.

“Client” refers to the person for whom the agency has agreed to provide childcare services or home help.

“Agency” refers to Playtime Nannies, Au Pairs and Housekeepers.

 

AU PAIR SERVICE

 

Definitions

"Applicant and Au Pair" refers to a person introduced by the Agency to the Client as an Au Pair as outlined in the BAPAAguidelines.
"Client" refers to the family/person for whom the Agency has agreed to provide an Au Pair for.
"Agency" refers to Playtime.

The Agency

Playtime is an agency placing Au Pairs, Nannies and Housekeepers in South East England.

The agency acts as an agent for introductions between an Applicant and a family. We do not employ Applicants.

All our Applicants are thoroughly vetted by us and/or our partner agencies.

Although many of our Applicants have a great deal of childcare experience, on some occasions, they may not be qualified child-carers.

The Agency

Playtime is an agency placing Au Pairs, Nannies and Housekeepers in South East England.

Playtime acts as an agent for introductions between Au Pairs and families. We do not employ Applicants.

Au Pairs must be treated as equals, and the arrangement between the family and the Au Pair should be mutually beneficial.

Although many of our Au Pairs have childcare experience, they are not qualified child-carers.

Changes to Employment

  1. The Client agrees to notify the agency immediately of any re-engagement of an Applicant or extension of what was originally a temporary employment.
  2. If an Applicant who was originally employed by the Client on a temporary basis, is re-employed by the Client within one calendar year of the termination of the original period of employment, then a further fee shall be payable to the agency.
  3. If an Applicant who was originally employed on a permanent part time basis becomes a full-time employee of the Client within one calendar year, then a further fee shall be payable to The agency.
  4. If the employment of an Applicant is extended beyond the period originally agreed between the Client, the Applicant and the agency, then an additional fee shall be payable to the agency.
  5. If a Client has to delay the commencement of the employment of an Applicant due to special circumstances (for example because of the birth of a baby later than expected), then the Client shall be liable to pay the Applicant their full salary from the agreed start date.
  6. All Applicants must be re-booked and re-engaged through the agency. In the event of a family taking on an Applicant introduced by the agency directly, or passing the details of an Applicant to any third parties, the family will be responsible for any associated loss of agency earnings.

 

Cancellation

  1. If the Client cancels a confirmed placement after agreeing to employ the Applicant, then the Client will still be liable to pay the full introduction fee to the agency, and one month’s salary will be payable to the Applicant.

 

Replacement Guarantee

  1. The introduction fee includes a 28-day replacement guarantee.
  2. If the Applicant does not commence employment with the Client after accepting the position or if the Applicant leaves the employment of the Client within 4 weeks, then a replacement will be offered.
  3. The agency will replace your Nanny or Home-helper if the following criteria have been adhered to:
  • If the Client has paid the invoice within 7 days, and in any case prior to the commencement of the Applicant’s employment
  • If the Client has notified the agency within 2 days of the Applicant failing to take up employment or leaving
  • If the terms within ‘Responsibilities of the Client’ have all been met
  • If the Client is still intending to employ a Nanny/Home helper
  1. The agency will offer 1 suitable replacement to the Client. The replacement will be offered within 1 month of the first Applicant’s departure. Should the Client refuse the replacement, the agency can continue with a replacement search however, a new fee will be applicable.
  2. Should the Client find a replacement through another source, then the agency will cease to search for a replacement.
  3. No replacement will be given where the Client retains the Applicant’s services, even though the Client considers the Applicant unsatisfactory. And no replacement will be given where the Client withdraws their offer of employment to the Applicant before the date of employment commences.
  4. Other reasons for not providing a replacement include: requesting unreasonable duties or hours of work, and any physical, verbal or sexual harassment.
  5. The agency cannot offer replacements for short term or temporary Nannies/Home helpers who are placed with a family for less than 3 months.

 

Responsibilities of the Client

  1. It is the responsibility of the Client to specify their exact requirements and provide full details of the type of work and period of employment for which a Nanny/Home helper is required.
  2. The Client is to notify the agency immediately should they choose to engage an Applicant introduced by the agency. As a result of such engagement, the Client agrees to pay an introduction fee in accordance with the agency’s fee structure and payment terms.
  3. Whilst we thoroughly reference check all of our Applicants, it is the responsibility of the Client to satisfy himself as to the suitability of any Applicant supplied by the agency. We would encourage the Client to take up any references provided by the Applicant or the Agency, and to make appropriate checks of certificates and personal documents.
  4. The Client shall be responsible for arranging any appropriate medical examinations of the Applicant, and for checking their medical history. The Client is also responsible for obtaining any work permits required.
  5. The agency are not professional financial advisors. Whilst we can advise Clients on how to pay their Applicant’s salary/tax etc, the Client is legally responsible for their employee’s tax and national insurance contributions. The agency suggests contacting Nanny Tax (http://www.nannytax.co.uk), a professional company who can provide advice on such matters.
  6. Similarly, the agency holds no responsibility for the Applicant’s employment contract. These matters are to be arranged between the Client and the Applicant. The agency can provide a sample employment contract to the Client, which may be used as a guide or point of reference. Alternatively, Nanny Tax can also be contacted for advice on employment contracts.
  7. The agency suggests that the Client ensures that their home contents insurance includes cover for employees and public liability insurance for domestic workers, including child-carers.
  8. The agency does not accept responsibility for any loss, damage, expense or injury resulting from an introduction.

 

Driving

  1. If the Client requests the Nanny/Home helper to drive with their children in the car, it is the responsibility of the Client to make sure that they are happy with their standard of driving.
  2. If the Client provides a vehicle for the Nanny or Home helper to use whilst at work, it is the Client’s responsibility to ensure that it is fully insured. Under no circumstance should the Nanny/Home helper be expected to pay for accidental loss or damage to any work vehicle, nor should their salary be withheld to cover any such costs.
  3. If the Nanny/Home helper is to use their own car for work purposes, then any associated costs must be reimbursed.

 

AD-HOC & TEMPORARY NANNY SERVICE

These terms are in addition to the agency Nanny Service terms and conditions.

  1. Ad-hoc Nanny booking fees can vary, depending on circumstances. These include, but are not limited to: location, number of children, number of parents whose children need childcare. The agency will treat every case individually.
  2. If a Client cancels an ad-hoc booking, the agency booking fee still applies.
  3. If the booking is cancelled within 4 weeks of the start date then the Nanny should be paid 50% of the earnings they would have received from the employment.
  4. If an ad-hoc or temporary Nanny is employed in any other capacity by the Client, the agency must be notified and the relevant fee must be paid.
  5. If the Nanny’s details are passed on to any third parties, then the Client is responsible for any associated loss of earnings.
  6. If the Client wishes to book a Nanny for any other service or for additional days, this must be done through the agency, never directly.
  7. The Client is responsible for paying the Nanny directly.
  8. If the Nanny cancels prior to the booking, the agency will endeavour to find a replacement. If a replacement cannot be provided, the agency will refund the Client’s booking fee.

Changes to Circumstances

  1. The Client agrees to notify Playtime immediately of any re-engagement of an Au Pair or extension of what was originally a short-term placement.
  2. If the placement of an Au Pair is extended beyond the period originally agreed, then an additional fee shall be payable to Playtime.
  3. If a Client has to delay the arrival of an Au Pair the client will be liable to pay for any additional travel costs incurred by the Au Pair.

 

Cancellation

  1. If the Client cancels a confirmed placement after agreeing to invite the Au Pair then the Client will still be liable to pay the full introduction fee to Playtime.

Replacement Guarantee

  1. The introduction fee includes a 28-day replacement guarantee.
  2. If the Au Pair does not commence placement with the Client after accepting the position or if the Applicant leaves the family within 4 weeks, then a replacement will be offered.
  3. Playtime will replace your Au Pair if the following criteria have been adhered to:
  • If the Client has paid the invoice within 7 days, and in any case prior to the commencement of the Au Pair's placement.
  • If the Client has notified the agency within 2 days of the Au Pair leaving
  • If the terms within 'Obligations of a Host Family' have all been met
  • If the Client is still intending to invite an Au Pair
  1. Playtime will offer 1 suitable replacement to the Client. The replacement will be offered within 1 month of the first Au Pair's departure. Should the Client refuse the replacement, Playtime can continue with a replacement search however, a new fee will be applicable.
  2. Should the Client find a replacement through another source, then Playtime will cease to search for a replacement.
  3. No replacement will be given where the Client retains the Au Pair's services, even though the Client considers the Au Pair unsatisfactory. And no replacement will be given where the Client withdraws their offer to the Au Pair before the date arrival date.
  4. Other reasons for not providing a replacement include: requesting unreasonable duties or hours of work, and any physical, verbal or sexual harassment.
  5. Playtime cannot offer replacements for summer Au Pairs or short-term Au Pairs who are placed with a family for less than 3 months.

 

Responsibilities of the Client

  1. It is the responsibility of the Client to specify their exact requirements and provide full details of duties expected from the Au Pair.
  2. The Client is to notify Playtime immediately should they choose to engage an Au Pair introduced by Playtime. As a result of such engagement, the Client agrees to pay an introduction fee in accordance with Playtime' fee structure.
  3. The Client is to make sure they have satisfied themselves as to the suitability of the Candidate before they arrive. The Client is therefore STRONGLY ADVISED to check all details, including but not limited to, references, medical history and general background of the Candidate personally.
  4. Playtime suggests that the Client ensures that their home contents insurance includes cover for Au Pairs.
  5. Playtime does not accept responsibility for any loss, damage, expense or injury resulting from an introduction.

 

Driving

  1. It is the Client's responsibility to make sure that they are comfortable with the Au Pair's standard of driving and to provide suitable insurance. Plenty of practise and formal driving lessons must be provided where needed.
  2. Under no circumstance should the Au Pair be expected to pay for accidental loss or damage to the family’s vehicle. Nor should their pocket money be withheld to cover any such costs.

GENERAL

Our Service

  1. The fee charged by the agency to place an Applicant with a family is an introduction fee.
  2. The introductory service we provide includes help and support throughout the registration and selection process. Whilst we are happy to provide advice during the initial stages of a placement, it is up to the Client and the Applicant to make a relationship work.
  3. The agency cannot be held responsible if a relationship breaks down between an Applicant and a family.
  4. The agency cannot guarantee that an Applicant will complete the full duration of his or her placement. If the Applicant leaves earlier than expected, unfortunately, we cannot offer a refund outside of the 28-day replacement guarantee.

 

Fees & Payment

  1. The Client will be invoiced after accepting an Applicant either verbally or in writing.
  2. Fees must be paid within 7 days from the date of invoice, and before the Applicant commences employment or the Au Pair arrives.
  3. If the introduction fee is not paid within 7 days of invoicing a £10 surcharge will be added weekly. If the fee has still not been paid by the time the Applicant starts work then a 25% surcharge of the total will be added to the invoice.

 

Furthermore

  1. By registering with Playtime, the Client accepts and wholly understands Playtime Terms and Conditions.
  2. Any variation of this agreement (including any special terms and conditions agreed between the parties) shall only be applicable if agreed in writing between the Client and Playtime.
  3. These terms are subject to English Law.
